Federal Employers Liability Act

The risk of serious accident and death on railroads led Congress to approve the Federal Employers Liability Act (FELA) in 1908. FELA significantly changed the law of the law of common practice by allowing injured employees to claim damages without having to prove the negligence of their employer.

It also allows the claimant to make a claim without fear of job loss or employer retaliation. Compensations under FELA can cover a wide range of things, including past and future medical expenses, loss of wages, pain and suffering, and emotional stress.

Employers are responsible to provide a safe work environment.

An employer has a duty to ensure a safe work environment, and if they fail in this obligation they could be held accountable for any losses or injuries that could occur. They also have to educate their employees and check the workplace to ensure there are no dangers or unsafe conditions. They also have a responsibility to equip their employees with proper tools and safety gear.
