veterans disability lawsuit (www.encoskr.com website) - How to File a Veterans Disability Lawsuit
A veterans disability lawsuit could be the answer for many veterans suffering from disabilities due to their military service. The Department of veterans disability attorney Affairs offers benefits to veterans, such as medical care and special programs.
However, obtaining those benefits is a lot more difficult for Black veterans, according to a new lawsuit filed Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.
PTSD
If people suffer from trauma it can lead them to develop symptoms of post traumatic stress disorder (PTSD). The symptoms include anxiety, nightmares, or frightening flashbacks. This disorder can make a person avoid situations or places that are reminiscent of their painful experience. This can cause individuals to feel isolated and depressed. Counseling, medication and the support from family members can treat PTSD.
A new lawsuit jointly filed by Black veterans and the Yale law clinics revealed that the Department of Veterans Affairs denied disability compensation claims for Black veterans repeatedly over the course of decades. NPR's Quil Lawrence claims that a whistleblower has told the veterans that VA internal documents reveal that Black veterans were denied benefits more often than their white counterparts.
The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics showing that between 2001 and 2020, Veterans Disability Lawsuit the percentage for Black veterans who filed disability claims was rejected at 29.5 percent, as compared to 24.2% of white veterans.
The lawsuit seeks compensatory damage for Monk and Black veterans who were denied benefits unfairly. The lawsuit also seeks to make VA to reassess tens of thousands of other claims that were denied in error. The lawsuit was filed this week in federal court.
Traumatic Brain Injury
TBI symptoms can be acute or Veterans Disability Lawsuit may develop for hours, days or even weeks later. There are physical symptoms (headache fatigue, dizziness and headache) while others can be associated with issues with memory focus, emotions, or behavior. People with TBI may experience problems with their emotions, concentration, or even behavior. TBI may also have trouble getting around or with balance and vision.
The brain injury caused by a TBI can be caused by a bump, blow or jolt to the head regardless of whether it was caused by a sharp force or penetrating cut (such as from a shot). The impact could cause the skull to fracture which causes bleeding and bruising of the brain inside the skull. The brain can expand and push against the skull, cutting off blood circulation. The injury could affect the entire brain or a particular lobe of the brain.
Some TBIs are classified as open while others are closed. The classification is based on whether the skull has been damaged or not, as well as whether the skull was closed or opened by the impact. TBIs can range in severity from a concussion all the way to a being in a coma. People suffering from TBI are at a higher risk of developing depression, PTSD and other mental health conditions. Research suggests that having multiple moderate to severe TBIs may increase the risk of developing dementia and movement disorders in later life.
Post Traumatic Stress Disorder
Post-traumatic stress disorder (PTSD) occurs when someone has suffered a trauma. The symptoms can start when the event ends or even years later. They could include memory problems trouble with concentration and sleep, a feeling of anger and irritability, and being easily startled or jittery. There are some who be depressed or have suicidal thoughts. PTSD can cause issues at home, work, and in relationships. It can also lead to alcohol or drug dependence.

Certain people suffering from PTSD benefit from taking antidepressants, for example as selective serotonin-reuptake inhibitors or SNRIs. Medications help to control symptoms and make daily activities easier.
Some research is looking into ways to prevent PTSD and examining the possibility that genes or the brain can affect a person's response to a trauma. Others are exploring the ways in which a normal stress response develops into PTSD and how to treat it before it becomes a problem.
If you suspect PTSD It is vital to speak with a doctor. It is important to address issues that affect your daily routine, like difficulty relating to others, or being anger and frustrated. Certain people suffering from PTSD benefit from self-help, such as talking about their experiences in therapy or using methods of relaxation, such as deep breathing or a rhythmic exercise. The lawsuit claims that the VA has discriminated against Black veterans for decades, by disproportionately rejecting disability compensation claim at a higher rate than white veterans. The lawsuit was filed on behalf of Conley Monk who is an Vietnam War veteran who tried to access medical benefits as well as housing assistance and education benefits for more than 50 years. The lawsuit is being handled by Yale Law School’s Veterans Legal Services Clinic. Monk was represented during his successful fight to reverse his less-than honorable military discharge because of PTSD and other injuries.
The lawsuit claims that racial discrimination within the military justice system impacted the discharge status of Black service members, and that VA officials should've known this when deciding on disability compensation. It cites research that discovered that between 2001 and 2020 the average rate of denial for Black veterans who applied for disability compensation was 29.5 percent, compared to 24.2 percent for white veterans.
