Asbestos Legal Matters

After a long struggle, asbestos legal measures resulted in the partial ban in 1989 on the manufacture, processing and distribution of most asbestos-containing products. This ban remains in place.

The December 2020 final TSCA risk assessment for chrysotile asbestos found excessive health risks for humans for all ongoing uses of chrysotile asbestos. The April 2019 rule prohibits the return of these asbestos-containing products to the market.

Legislation

Asbestos laws are regulated both at the state and federal levels in the United States. The US makes use of asbestos in a wide range of products even though the majority of industrialized countries have banned it. The federal government regulates the way it is used in these different products and the law also regulates asbestos litigation and abatement. State asbestos laws can vary from one state to another although federal laws generally are uniform. These laws restrict the rights of those who have suffered asbestos-related injuries.

The EPA's 1989 Asbestos Ban and Phase-Out Rule was designed to place an end to the manufacturing, importation processing, and distribution of asbestos-related products in the US. This was reversed in 1991. The EPA recently began examining chemicals that could be harmful and asbestos was added on its list of chemicals that could be harmful to humans.

The EPA has strict guidelines on how asbestos should be handled. However it is important to note that asbestos is still present in a variety of structures. This means that people could be exposed to asbestos. Therefore it is recommended to make an effort to find all asbestos-containing materials and checking their condition. They must also establish a decontamination zone and supply employees with protective clothing.

When the work is complete, a certified inspector must check the area and ensure that there aren't any asbestos law fibres released into the air. The inspector should also verify that the sealant is "locking down" any asbestos attorney. After the inspection, a sample of air should taken. If it shows the asbestos concentration exceeds the required level, the site needs to be cleaned up again.

The disposal and transport of asbestos is regulated by the state of New Jersey and is monitored by the Department of Environmental Protection (DEP). Any business planning to dispose of asbestos-containing material must get a permit from the Department of Environmental Protection before commencing work. Asbestos can be found in roofing and floor tiles shingles, as well as in cement, exterior siding and automotive brakes. These products can release fibers into the air when the ACM is disturbed or removed. The risk of inhalation comes because the fibers are too small to be seen by the naked eye.
