Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for many veterans disability law firm who suffer from disabilities as a result of their military service. The Department of Veterans Affairs provides benefits to those who been in the military, such as medical care and specialty programs.

However, obtaining these benefits is a lot more difficult for Black veterans, as per a new lawsuit filed Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.

PTSD

PTSD symptoms can manifest when traumatized people suffer. The symptoms include nightmares, anxiety or disturbing flashbacks. This condition can cause people to avoid situations or places that bring back memories of their trauma experience. This can lead people to feel isolated and depressed. Counseling, medication and support from family members can help combat PTSD.

A new lawsuit filed by Black veterans and a Yale law clinic has found that the Department of Veterans Affairs has repeatedly denied disability compensation claims to Black veterans for decades. Quil Lawrence of NPR reports that a VA whistleblower revealed to the vets that VA documents showed that Black veterans were denied benefits at a higher percentage than their white counterparts.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites data that shows that from 2001 until 2020 the rate of rejection for Black disability claims was 29.5 percent, as compared to 24.2 percent for white veterans.

The lawsuit seeks compensatory damages for Monk and other Black veterans who were denied access to benefits. The lawsuit also seeks to for the VA to review tens or thousands of other claims which were denied in error. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI symptoms can be present immediately or appear for days, hours or even weeks later. Some symptoms (headache dizziness, headache, fatigue) are physical, whereas others could be related to emotions, memory, concentration or behavioral issues. People suffering from a TBI might also have difficulty moving around or with balance and vision.

Research suggests that having multiple moderate to severe TBIs could increase the likelihood of developing dementia and other movement issues in later life.

Post Traumatic Stress Disorder

Post traumatic stress disorder, also known as PTSD is a condition that occurs after people suffer a trauma. The symptoms can manifest immediately following the event or years later. Memory issues, trouble concentrating and sleeping, feelings of anger or irritability, and being easily startled are some of the symptoms. Some people may feel depressed or suicidal. PTSD can cause problems at workplace, in relationships and at home. It can also cause alcohol or drug addiction.

Psychotherapy can treat symptoms, such as eye movement desensitisation (EMDR) and cognitive processing therapy. Some people with PTSD benefit by taking antidepressants, such as selective serotonin reuptake inhibitors or SNRIs. These medications can help control symptoms and make daily activities easier.

Some research is investigating ways to prevent PTSD by examining the possibility that genes or the brain may affect a person's reaction to a trauma. Other studies are looking at how a normal stress response develops into PTSD and how to treat it early.

The suit was filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful effort to overturn his less-than-honorable military discharge due to PTSD and other injuries.

The lawsuit claims that racial bias within the justice system of the military affected the discharge status of a lot of Black service members, and VA officials should have been aware this when they made decision-making regarding disability compensation. The lawsuit cites a study which discovered that between 2001 and the year 2020, the average denial rate of Black veterans who applied to receive disability compensation was 29,5%, compared with 24,2% for white veterans.
