Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit
A lawsuit for veterans' disability could be the solution for many veterans suffering from disabilities due to their military service. The Department of Veterans Affairs provides benefits to those who been in the military, including medical care and specialty programs.
According to a lawsuit filed on Monday, Black veterans have disproportionately more difficulty getting these benefits. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.
PTSD
If someone experiences trauma it can lead them to develop symptoms of post-traumatic stress disorder (PTSD). Symptoms include anxiety, nightmares or disturbing flashbacks. This condition can make an individual to avoid certain situations or places that remind them of their traumatic experience. This could lead to isolation and depression. A new lawsuit brought jointly by Black veterans and the Yale law clinics found that the Department of Veterans Affairs denied disability compensation claims for Black vets systematically over decades. NPR's Quil Lawrence reports that a whistleblower told the vets that VA internal documents revealed that Black veterans were more often denied benefits than their white counterparts.
The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics that show that from 2001 to the rejection rate for Black disability claims was 29.5 percent, compared with 24.2% for white veterans disability lawsuits.
The lawsuit seeks to recover compensation for Monk and Black Veterans Disability Lawyers who were wrongfully denied benefits. It is also seeking to force the VA to reassess the claims of thousands of other veterans who were incorrectly dismissed. The lawsuit was filed this week in federal court.
Traumatic Brain Injury
TBI symptoms can be present immediately or manifest for days, hours or even weeks later. Some signs (headache dizziness, headache) are physical, while others could be related to memory, concentration, emotion or behavior issues. TBI patients may also experience difficulties moving or with vision and balance.
The damage to the brain from a TBI can be caused by a bump, blow or jolt to the head, regardless of whether it was caused by a sharp force or a penetrating injury (such as from a shot). The impact can cause skull fracture that can lead to bleeding and bruising of the brain within the skull. The brain could then swell, pushing against the skull, causing a cut in blood flow. The injury could happen to the entire brain or the lobe in which it is located.
Some TBIs can be classified as closed while others as open. The classification is determined by the extent to which the skull has been broken and whether or not the skull was shattered or opened due to the impact. TBIs vary in severity, ranging from concussions all the way to fatal coma. People who suffer from TBI are at greater risk of developing depression, PTSD and other mental health conditions. Certain studies suggest that having multiple moderate to severe TBIs can increase the risk of developing dementia and other movement disorders later in life.

Medications can help control the symptoms and make it easier to get through daily activities.
Some research is exploring how to stop PTSD and examining whether the brain or genes can affect a person's response to a trauma. Other studies are looking at how a normal stress response changes into PTSD and how to treat it in the early stages.
