The area of malpractice law is one of tort law that focuses specifically with professional negligence. A malpractice lawsuit must meet four basic requirements.

Duty of care
When you have an established doctor-patient relationship, the doctor has a duty of caring to you. This is no matter if the doctor treats you at a hospital or in your home. Anyone who is under a duty to care must act in a way that reasonable people would act under the circumstances. Doctors are responsible for the health of their patients at all times. Medical professionals also have a duty of care to inform their patients of the dangers associated with certain procedures and treatments. In the absence of this, it is a breach of a doctor's duty. Breach of duty
