Attorneys who exploit disabled veterans to make money often rely on their benefits. You need an attorney that is licensed to manage VA claims.
A Connecticut veteran who suffered schizophrenia post-traumatic disorder, schizophrenia and other mental conditions linked to an air carrier crash that killed a number of people has won a major victory. However, it comes with an expense.
Class Action Settlement
The Department of Veterans Affairs has systematically discriminated against Black Veterans disability lawsuit by refusing disability compensation claims at a higher rate than white veterans, as per a lawsuit filed on Monday. Conley Monk is 74 years old and a Marine Corps veteran who served during the Vietnam War, is the plaintiff in the lawsuit. According to documents obtained by Monk and the Yale Law School Veterans Legal Services Clinic and Monk claims that the VA denied his disability claim at a greater rate than white veterans over the last three decades.
Monk, who is a retired psychiatric nurse, says that the discrimination by the VA has caused him and other black veterans to suffer in ways that have affected their health, homes work, education and employment. He is requesting that the VA compensate him for benefits it has deprived him of and to amend its policies regarding race as well as discharge status and denial rates.
In the past year, Monk and the Veterans Legal Services Clinic obtained 20 years of VA disability compensation claim data by way of Freedom of Information Act requests which they filed on behalf of the National Veterans Council for Legal Redress and the Black Veterans Project. This data showed that Black veterans were statistically less likely to be granted a disability claim than white veterans between 2001 to 2020. The average denial rate for veterans of color was 6.3 percent higher than white veterans.
Discrimination is based on PTSD
According to a lawsuit filed Monday that the Veterans Affairs Department denies disability benefits to Black veterans disability attorney. The lawsuit is brought by an ex- Marine Corps vet who was denied housing or education, as well as other benefits despite having been diagnosed with PTSD. The suit points to evidence that VA officials have historically denied claims submitted by Black veterans.
Conley Monk was a volunteer in the Marines during the Vietnam War, driving a bullet-riddled transport vehicle and assisting in the transportation of troops and equipment to battle zones. Conley Monk was later involved two battles which he blamed on his PTSD. In 1971, he received a discharge that was not acceptable. This "bad paper" kept him from receiving loans for homes or tuition aid as well as other benefits.
He filed a lawsuit against the military to revers the discharge and was awarded full benefits both in 2015 and in 2020. However, he claims the VA still is owed money for the denials he received in the past of disability compensation. He also suffered a lot of emotional harm from reliving the most traumatic memories in each application and re-application to receive benefits, the suit states.
The lawsuit seeks financial damages and asks the court to order the VA to examine the systems-wide PTSD bias. This is the latest initiative by groups like the ACLU and Service Women's Action Network to make it mandatory for the VA to address the long-running discrimination against sexual assault survivors.
Alimony Discrimination
Anyone who was in uniform or who accompanied them, deserve to know the truth about veterans disability benefits and their impact on divorce financial issues. One of the biggest myths is that veterans can have their VA compensation seized to pay child support or alimony orders in state courts. This isn't the case. Congress carefully designed Title 38 of the U.S. Code to shield the veterans' compensation against claims from creditors and family members, except for child support and alimony.
Conley Monk accepted a call to serve his country. He spent two years in Vietnam driving bullet-riddled transport vehicles, transferring equipment and troops from combat zones. He was awarded several medals for his service, but he was later issued a less-than-honorable discharge when he got into two fights caused by undiagnosed PTSD. The battle to get the VA to grant his claim for disability compensation was a long and winding route.
He was denied benefits at a higher rate than white counterparts. According to the lawsuit brought in his behalf by the National Veterans Council for Legal Redress at Yale Law School and the Veterans Legal Services Clinic, this racial bias was systemic and widespread. It claims that the VA knew about and failed to deal with decades of discrimination against Black veterans. It seeks to redress Monk and other veterans who are like him.
Appeal
The VA's Board of Veterans Appeals reviews claims for benefits when a claimant disagrees with a decision the agency has made. If you are considering appealing the decision, it is crucial to file an appeal as soon as possible. A lawyer who is experienced in appeals to veterans' disability cases can help ensure that your appeal is compliant with all requirements and it is heard in a fair manner.
A licensed lawyer can examine the evidence that was used to back your claim and provide additional evidence and documentation in the event of need. A lawyer will also know the challenges of dealing with the VA and this could lead to a greater level of empathy for your circumstance. This can be a valuable benefit to your appeals.
A veteran's claim for disability is often denied because the agency didn't accurately describe their condition. A skilled lawyer can make sure that your condition is classified and rated correctly, thus granting you the benefits you deserve. A professional attorney will also be able to collaborate with medical experts to provide additional proof of your health condition. A medical professional, for example, may be able to prove that the pain you are experiencing is due to your service-related injury and is disabled. They may also be able to help you obtain the medical records required to prove your claim.
