Making Medical Malpractice Legal

Medical malpractice is a highly specialized legal field. Physicians should be proactive to safeguard themselves from legal liability by purchasing a sufficient medical malpractice insurance.

Patients must prove that the physician's breach of duty caused harm to them. Damages are determined by the actual economic loss such as lost income or the cost of future medical procedures, in addition to non-economic losses like suffering and pain.

Duty of care

The first thing a medical malpractice attorney needs to establish in a case is the duty of care. All healthcare professionals have a responsibility towards their patients to act in accordance with the standards of care appropriate to their particular field. This includes nurses, doctors and other medical malpractice lawyer professionals. Breach of duty

Damages

Medical malpractice cases are usually complex and require expert testimony.
