Monk and the Veterans Legal Services Clinic received 20 years of VA disability claim information in the past year as part of a Freedom of Information Act request that they submitted on behalf of National veterans disability attorney Council for Legal Redress and the Black Veterans Project. These figures showed that Black Veterans were statistically less prone to be granted the right to claim disability benefits than white veterans from 2001 until 2020. The average denial rate for veterans of color was 6.3 percent higher than white veterans.

However, he asserts that the VA still is owed money for his previous denials of disability compensation. He also suffered severe emotional harm as he relived some of his most traumatizing memories each time he applied and re-application, the suit states.
The lawsuit seeks monetary damages and also to require the VA to examine its the systemic PTSD bias. It is the latest move by groups like the ACLU and Service Women's Action Network to get the VA to address long-running discrimination against victims of sexual assault.
