Asbestos Legal Matters

After a long battle, asbestos legal measures resulted in the 1989 partial ban on the manufacturing, processing, and distribution of a majority of asbestos-containing products. This ban remains in effect.

The December 2020 final TSCA risk assessment for chrysotile asbestos identified unreasonable health risks to humans for all current uses of chrysotile asbestos. The April 2019 rule prohibits the return of these asbestos products to the marketplace.

Legislation

In the United States, asbestos attorney laws are enforced at both the state and federal level. While many industrialized countries have banned asbestos but the US still uses it in many different products. The federal government regulates the use of asbestos in these products as well as regulates asbestos litigation. State asbestos laws can differ from state to state even though federal laws are generally uniform. These laws often restrict claims for those who have suffered from exposure to asbestos.

Asbestos can be found naturally. It is extracted from the underground, typically using open-pit mining methods. It is made up of fibrous strands. The strands are then processed and mixed with a binding agent such as cement to create an asbestos-containing material, also known as ACM. These ACMs can be utilized in a variety applications, such as floor tiles, roofing, clutch facings and shingles. Asbestos is not just used in construction materials, but also in other products such as batteries, fireproof clothing, and gaskets.

The Environmental Protection Agency (EPA) has strict guidelines on how asbestos is used in schools and in homes. The EPA demands that schools inspect their facilities and create plans for the identification, containment and management of asbestos-containing materials. The EPA also requires that people working with asbestos be accredited and certified.

The EPA's Asbestos Ban Phase-Out Rule of 1989 was created to prohibit the manufacture, importation, processing, and distribution of asbestos-related materials within the US. This was changed in 1991. The EPA recently began reviewing chemicals that could be harmful and asbestos was added on its list.

While the EPA has strict rules for how asbestos can be treated but it is important to be aware that asbestos remains in a number of buildings and that people are at risk of being exposed to it.
