Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for a lot of veterans suffering from disabilities as a result of their military service. The Department of Veterans Affairs offers benefits to veterans, including medical care and programs for veterans.

However, obtaining these benefits is disproportionately difficult for Black veterans, as per a new lawsuit filed on Monday. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

PTSD symptoms can manifest when someone is traumatized. The symptoms can include flashbacks, nightmares, or anxiety that cause anxiety. The condition may also cause a person to avoid certain locations or situations that trigger the trauma. This can cause people to feel lonely and depressed. The good news is that PTSD can be treated with counseling and medication as well as the support of loved ones.

A new lawsuit jointly filed by Black veterans and the Yale law clinics found that the Department of Veterans Affairs denied disability compensation claims of Black veterans repeatedly over a long period of time. Quil Lawrence of NPR reports that a VA whistleblower revealed to the veterans that VA documents showed that Black veterans disability law firm were denied benefits at a higher rate than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics showing that between 2001 and 2020, the rate for Black veterans with disability claims was rejected at 29.5% compared to only 24.2% of white veterans.

The lawsuit seeks compensation for Monk and other Black veterans who were denied access to benefits. The lawsuit also seeks to oblige VA to reassess tens of thousands of other claims that were wrongly denied. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI symptoms can be acute or may develop for hours, days or even weeks later. There are also group therapies that bring people suffering from the same condition together in a safe and supportive setting.

The lawsuit claims that the VA discriminated against Black veterans for decades by refusing disability claims at greater percentages than white veterans. Conley Monk is a Vietnam War veteran, who has been fighting for medical benefits, housing benefits and education benefits for over 50 years. The lawsuit was filed by Yale Law School’s Veterans Legal Services Clinic. Monk was represented in his successful bid to rescind his less than honorable discharge from the military due to PTSD and other injuries.

The lawsuit asserts that racial discrimination in the military justice system impacted the discharge status of Black service members, and that VA officials should've known this when making decisions about disability compensation. The lawsuit cites a study which found that between 2001 and 2020 the average rate of denial for Black veterans who applied for disability compensation was 29,5%, Veterans disability lawsuit as opposed to 24,2 percent for white veterans.
