Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A lawsuit for veterans' disability could be the answer for many veterans who suffer from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who have been in the military, such as medical care and specialty programs.

According to a lawsuit filed on Monday, Black veterans have disproportionately having a harder time in obtaining these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

PTSD symptoms can develop when someone is traumatized. The symptoms include nightmares, anxiety or troubling flashbacks. This condition can make a person avoid places or situations that remind them of their traumatic experience. This can lead people to feel lonely and depressed. A lawsuit that was filed by Black veterans and a Yale law clinic has revealed that the Department of Veterans Affairs has consistently denied disability compensation claims to Black veterans for a long time. NPR's Quil Lawrence claims that a whistleblower has told the veterans that VA internal documents revealed that Black Veterans Disability Lawyers were denied benefits more often than white veterans.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and veterans Disability lawyers Yale's Veterans Legal Services Clinic. The lawsuit cites figures showing that between 2001 between 2001 and 2020, the average rate for Black veterans who filed disability claims was rejected at 29.5% compared to only 24.2% of white veterans.

The lawsuit seeks compensation for Monk and veterans Disability Lawyers other Black veterans disability attorney who were unfairly denied benefits. The lawsuit also seeks to make VA to reconsider tens of thousands of other claims which were incorrectly denied. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI symptoms may be apparent immediately or may develop for hours, days or even weeks later. The symptoms can be treated with psychotherapy, including eye movement desensitisation and reprocessing (EMDR) or cognitive processing therapy. Antidepressants like selective Serotonin Reuptake Inhibitors (SNRIs) are beneficial for those suffering from PTSD. The medication helps to manage symptoms and make daily activities easier.

A few studies are looking at ways to prevent PTSD, including looking at whether the brain or genes can affect the way a person reacts to a trauma. Other studies are looking at how a normal stress response transforms into PTSD and how to treat it early.

The lawsuit says that racial bias within the justice system of the military affected the discharge status of a number of Black service members, and VA officials should have been aware this when making disability compensation decisions.
