Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for many veterans who suffer from disabilities as a result of their military service. The Department of Veterans Affairs offers benefits to veterans, including medical treatment and special programs.

According to a lawsuit filed Monday, Black veterans have disproportionately more trouble in obtaining these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

If someone experiences trauma it may cause them to develop symptoms of post traumatic stress disorder (PTSD). The symptoms include nightmares, anxiety, or frightening flashbacks. The condition can make an individual to avoid certain places or situations which bring back memories of their trauma experience. This can cause a sense of isolation and depression. A new lawsuit jointly filed by Black veterans and Yale law clinic found that the Department of Veterans Affairs denied disability compensation claims made by Black vets systematically over decades. Quil Lawrence of NPR reports that a VA whistleblower informed the vets that VA documents showed that Black veterans were denied benefits in a higher proportion than white veterans.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites data that show that between 2001 and 2020, the percentage for Black veterans who filed disability claims was rejected at 29.5 percent compared to 24.2 percent of white veterans.

The lawsuit seeks damages for compensation for Monk and other Black veterans who were denied benefits. It is also seeking to force the VA to reconsider the thousands of other claims that were dismissed in error. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate or serious and symptoms can be immediately visible or they may appear within a few hours or even weeks after the injury. TBIs can range in severity from a concussion up to a being in a coma. Patients with TBI are at increased risk of developing depression, PTSD and other mental health conditions. Some research suggests that having a variety of moderate to severe TBIs can increase the risk of developing dementia and other movement disorders later in life.

Post Traumatic Stress Disorder

Post-traumatic stress disorder (PTSD) occurs when the victim experiences trauma. The symptoms can manifest immediately following the event or even years after. Memory issues, trouble getting sleep and concentrating, or feelings of anger or irritability and being easily startled are some of the symptoms. Certain people may be depressed or have suicidal thoughts. The PTSD condition can cause issues at workplace, in relationships and at home. It can also lead alcohol or drug addiction.

The symptoms can be treated with psychotherapy, which includes eye movement desensitisation and reprocessing (EMDR) or cognitive processing therapy. Some sufferers of PTSD benefit from taking antidepressants, for example as selective serotonin reuptake inhibitors or SNRIs. The medication helps to manage symptoms and make everyday activities more enjoyable.

Monk was represented in his successful attempt to reverse his less-than honorable discharge from the military due to PTSD and other injuries.

The lawsuit claims that racial discrimination within the military justice system affected the discharge status of Black service members and VA officials should have known this prior to making decisions regarding disability compensation. The lawsuit cites research that found that between 2001 and 2020, the average denial rate of Black veterans who applied for disability compensation was 29,5% compared with 24,2% for white veterans.
