Medical Malpractice Law

Even with the best training and an oath to do no harm, medical mistakes could happen. When they do, the results can be devastating for patients.

Malpractice law is a branch of tort law that focuses on professional negligence. A malpractice lawsuit must satisfy four basic requirements:

Malpractice claims in the United States are typically filed in state trial courts. Numerous legal tools, like depositions under oath, are utilized to gather evidence to support the case.

Duty of care

If you are in the relationship of a doctor-patient, a doctor has a responsibility of caring to you. This is no matter if the doctor is treating you in the hospital or at your home. It also seeks to reduce costs by making sure that all defendants share the responsibility for the success of a lawsuit (joint and several responsibility) and limiting the total amount a plaintiff is able to be awarded if other defendants aren't able to provide funds to pay ("damage caps") and stopping doctors from practicing defensive medicine, which entails changing their treatment plans in response to the threat of malpractice lawsuits.
