The Federal Employers? Liability Act Protects Railroad Workers

As the railroad industry grows, so too is the possibility of being injured while working. Unlike other types of workers, railroad workers do not have access to the state-run worker's compensation systems. Instead, they are protected by an unwritten law that protects them from negligence by employers.

Railroad workers face a unique set of safety issues on the job. To prevent accidents at work, railroad workers are held to an elevated standard. The Federal Employers Liability Act allows railroad workers injured in accidents to sue their employers. FELA differs from regular workers' comp which protects workers in other industries. In 1908, Congress passed FELA in order to ensure that railroad workers received compensation for their injuries. The law was not meant to provide railroad workers with full compensation. Instead, the law requires that the injured worker prove that their injury was caused by the railroad's negligence. The law prohibits employers from denying a claim that is based on the negligence of a contributor.
