What Makes Medical Malpractice Legal?

Medical malpractice claims are subject to strict legal requirements. This includes meeting a statute-of-limitations and proving that the injury was caused by negligence.

All treatments come with some degree of risk. A doctor must inform you of these risks to obtain your informed consent. Some adverse outcomes are not the result of malpractice.

Duty of care

A patient is owed by a doctor the duty of care. If a physician fails adhere to the medical standard of care, it can be considered to be malpractice.
