Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for many veterans suffering from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who have been in the military, such as medical care and specialty programs.

According to a lawsuit filed Monday, Black veterans have disproportionately more trouble obtaining these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

When someone is traumatized they may be prone to develop symptoms of post-traumatic stress disorder (PTSD). The symptoms include anxiety, nightmares or disturbing flashbacks. This disorder can make a person avoid areas or situations that remind them of their traumatic experience. This can lead individuals to feel isolated and depressed. A new lawsuit brought jointly by Black veterans and the Yale law clinic found that the Department of Veterans Affairs denied disability compensation claims for Black vets systematically over decades. Quil Lawrence of NPR reports that a VA whistleblower informed the vets that VA documents revealed that Black veterans were denied benefits at a higher percentage than their white counterparts.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics that show that from 2001 until 2020, the rate of rejection for Black disability claims was 29.5 percent, compared with 24.2% for white veterans.

The lawsuit seeks compensation for Monk and other Black veterans who were unfairly denied access to benefits. It also seeks to force the VA to review the claims of thousands of other veterans who were wrongly dismissed. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate or even severe and symptoms may be immediately apparent or they may develop days or weeks after the injury. Some research suggests that having multiple moderate to severe TBIs can increase the risk of dementia and movement disorders later in life.

Post Traumatic Stress Disorder

Post traumatic stress disorder, also known as PTSD is the result of having to undergo a trauma. It can be apparent immediately following the event or years later. Memory problems, difficulty concentrating and sleeping, feelings of anger or irritability as well as being easily shocked are some of the symptoms. Conley Monk is a Vietnam War veteran, who has been battling to receive medical benefits including housing, education and housing benefits for more than 50 years. The suit was filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful bid to reverse his less-than honorable military discharge due to PTSD and other injuries.

The lawsuit claims that racial discrimination in the military justice system impacted the discharge status of Black service members, and that VA officials should have been aware of this when deciding on disability compensation. It cites research that discovered that between 2001 and 2020, the average denial rate for Black veterans who applied for disability compensation was 29.5%, compared to 24.2 percent for white veterans.
