A Connecticut veteran who suffered from schizophrenia post-traumatic stress disorder and other mental health conditions linked to a fatal air carrier collision has won a major victory. But it comes with a substantial price tag.
Class Action Settlement
The Department of Veterans Affairs has systematically discriminated against Black veterans by denying disability compensation claims at a higher rate than white veterans, as per a lawsuit filed on Monday. Conley Monk is a 74-year-old Marine Corps veteran from the Vietnam War who filed the lawsuit. He alleges that VA has denied his disability claims at a higher rate than those of white veterans over the past three decades, according to agency records obtained by Monk and the Yale Law School Veterans Legal Services Clinic.
Monk, an a retired psychiatric nurse says that the discrimination by the VA has caused him and other black veterans to be affected in ways that have affected their health, home, employment and education. He wants the VA to compensate him for the benefits they have denied him, and to alter their policies regarding race, discharge status, and denial rates.
Monk and the Veterans Legal Services Clinic received 20 years of VA disability claim data last year via a Freedom of Information Act request, which they submitted on behalf of National Veterans Council for Legal Redress and the Black Veterans Project. These data showed that Black Veterans were statistically less prone to be granted an application for disability than white veterans from 2001 to 2020. Additionally, the average denial rate was 6.3 percent higher for veterans of color than for white veterans.
Discrimination based on PTSD
According to a lawsuit filed on Monday that the Veterans Affairs Department denies disability benefits to Black veterans. The suit was filed by a former Marine Corps veteran who was denied housing, education, and other benefits for a long time, even though he suffered from undiagnosed post-traumatic stress disorder (PTSD). The suit provides evidence that VA officials have historically disproportionately denied claims from Black veterans.
Conley Monk decided to join in the Marines during the Vietnam War, driving a shot-scarred transport vehicle and assisting in the transportation of equipment and troops to combat zones. He eventually got into two fights with fellow Marines which he blamed on his PTSD and was awarded a discharge from the military that was not honorable in 1971. This "bad paper" hindered him from receiving mortgages, tuition assistance and other benefits.
He filed a lawsuit against the military to rescind the discharge and was awarded a full range of benefits in 2015 and 2020. But, he claims that the VA still is owed money for his previous denials of disability compensation. He also suffered significant emotional trauma from reliving some of his most traumatizing memories each time he applied and re-application for benefits, the suit states.
The lawsuit seeks monetary damages and also asks the court's order for the VA to review its systemic PTSD discrimination. The lawsuit is the latest effort by groups such as the ACLU and Service Women's Action Network, to pressure the VA into addressing long-standing discrimination against survivors of sexual assault.
Alimony Discrimination
The veterans who have served our country in uniform or those who accompany them deserve truthful information about the veterans disability compensation and its influence on the financial aspects of divorce. One of the most popular myths is that veterans can have their VA compensation seized in order to pay alimony or child support orders in state courts. This is not the case. Congress has carefully designed Title 38 of the U.S. Code to protect the veterans' compensation from claims brought by family members and creditors including alimony and child support.
Conley Monk, a volunteer for his country, logged two years in Vietnam driving bulletproof transport vehicles, as well as moving troops and equipment out of combat zones. Monk was awarded several medals in recognition of his service, however he was later given a less-than-honorable discharge after getting into two fights that were not diagnosed as being caused by PTSD. His battle for the VA to approve his claim for disability compensation was a long and arduous road.
He was denied benefits at a greater rate than his white counterparts. According to the lawsuit filed in his behalf by the National Veterans Council for Legal Redress at Yale Law School and the Veterans Legal Services Clinic, the discrimination against Black veterans was systematic and widespread. It asserts that the VA was aware of and failed to confront decades-old discrimination against Black veterans disability lawyer. It seeks justice for Monk and other veterans.
Appeal
The VA Board of Veterans Appeals examines claims for benefits if the applicant is not satisfied with an opinion of the agency. If you're thinking of appealing the decision, it is essential to do so immediately. A veteran disability lawyer can ensure that your appeal meets all requirements and fwme.eu receives a fair hearing.
A competent lawyer will review the evidence that supports your claim and, if necessary, submit new and additional evidence. A lawyer will also know the difficulties involved in dealing with the VA and could increase the level of empathy for your circumstance. This can be an important advantage in your appeals.
One of the main reasons why a claim for disability benefits from a veteran is denied is because the agency hasn't properly defined their condition. A skilled lawyer can make sure that your condition is properly classified and rated appropriately, giving you the benefits you deserve. A qualified attorney will also be able to work with medical professionals to provide additional proof of your medical condition. For example an expert in medicine may be able to show that the pain you feel is related to your service-connected injury and is causing disability. They could be able to assist you in getting the medical records required to prove your claim.
