Four Elements of a Medical Malpractice Case

To sue a physician over malpractice, the patient must establish the following elements using a preponderance of proof: breach of duty, causation, and damages.

Duty of Care

The first thing to consider in a medical malpractice case is that the victim was owed a duty by a doctor which was not fulfilled. In general, doctors who treat patients must follow the standards that are accepted in their profession and practice.

Doctors could also be held responsible for the negligence or incompetence of their staff members, for example, assistants or interns. They could also be held accountable for the actions of emergency personnel who are under their supervision.

The next thing that a plaintiff has to prove is that the defendant failed to meet the standard of care in the circumstances. This can be established with expert testimony about acceptable medical practices and the defendant's refusal to follow these standards. The second aspect of malpractice is that this breach directly caused injury to the patient. To prove that you have committed a crime your lawyer must to prove that the defendant's breach of duty directly caused your injury or death of your loved one. This concept is known as the proximate cause. Breach of Duty
