For a lot of veterans suffering from disabilities as a result of their military service, a veterans disability lawsuit might be the solution. The Department of Veterans Affairs provides benefits to those who have been in the military, including medical care and specialty programs.
According to a lawsuit filed Monday, Black veterans have disproportionately more difficulty in obtaining these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.
PTSD
If people suffer from trauma they may be prone to develop symptoms of post traumatic stress disorder (PTSD). Symptoms may include flashbacks, nightmares or anxiety that cause anxiety. This disorder can make the sufferer to avoid places or situations which are reminiscent of their painful experience. This can lead people to feel depressed and depressed. A new lawsuit brought jointly by Black veterans and Yale law clinics found that the Department of Veterans Affairs denied disability compensation claims for Black veterans repeatedly over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower told the veterans disability lawyer that VA documents revealed that Black veterans were denied benefits at a higher rate than their white counterparts.
The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. It cites data showing that from 2001 until 2020 the rejection rate for Black disability claims was 29.5 percent, as compared to 24.2 percent for white veterans.
The lawsuit seeks compensatory damages for Monk and other Black veterans who were unfairly denied access to benefits. The lawsuit also seeks to oblige VA to reconsider tens of thousands of other claims which were wrongly denied. The lawsuit was filed in federal court this week.
Traumatic Brain Injury
TBI can be mild, moderate, or severe and symptoms may be immediately apparent or may develop hours or even weeks after the injury. Some signs (headache dizziness, headache, fatigue) are physical, whereas others may be related to emotions, memory, concentration or behavior problems. TBI patients might also experience difficulty moving or with balance and vision.

Conley Monk is a Vietnam War veteran, who has been trying to obtain medical benefits including housing, education and housing benefits for more than 50 years. The lawsuit is being filed by Yale Law School’s Veterans Legal Services Clinic. Monk was represented in his successful attempt to rescind his unhonorable discharge from the military due to PTSD and other injuries.
The lawsuit asserts that racial discrimination in the military justice system impacted the discharge status of a lot of Black service members and VA officials should have known this when they made disability compensation decisions. It cites research that found that between 2001 and the year 2020, the average rate of denial for Black veterans who applied for disability compensation was 29.5 percent, compared to 24.2 percent for white veterans.
