Asbestos Lawsuits

The EPA has banned the production, importation and processing of the majority of asbestos-containing materials. However, asbestos-related lawsuits are still appearing on court dockets. Several class action lawsuits against asbestos producers have also been filed.

The AHERA regulations define the term "facility", as an installation or assembly of buildings. This includes houses that have been demolished or renovated in conjunction with a project or installation.

Forum shopping laws

Forum shopping is the process of litigants seeking dispute resolution from a court (jurisdiction) which is believed to offer the best chances of a favorable decision. This practice can occur between states or between federal and state courts within a single country. This can also happen between countries with different legal systems. In some instances plaintiffs can search for the best court to bring their case.

Forum shopping is harmful not only to the litigant but also to the justice system. Courts must be free to determine whether a case is valid and then to make a fair decision without being clogged with unnecessary lawsuits. When it comes to asbestos this is particularly important because many asbestos-related sufferers have chronic health issues resulting from exposure to the toxic substance.

In the US asbestos was largely banned in 1989. However it is still in use in countries like India and India, where there are few or no regulations on asbestos handling. The Centre for Pollution Control Board of the government hasn't been able to enforce basic safety standards. Asbestos may cause serious health problems, such as asbestosis and lung cancer. As asbestos fibers are breathed in, they can get caught in the lungs and can trigger inflammation. There are laws in place to reduce exposure to asbestos and to compensate victims suffering from asbestos-related diseases. The NESHAP regulations require that regulated entities notify the appropriate agency prior to any demolition or remodeling work on buildings that contain a particular amount of asbestos or asbestos-containing material.
