Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for many veterans suffering from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who have served in the military, such as medical care and special programs.

However, obtaining those benefits isn't easy for Black veterans, as per the latest lawsuit filed on Monday. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

When people experience trauma they may be prone to develop symptoms of post-traumatic stress disorder (PTSD). These symptoms could include anxiety, nightmares or flashbacks that are disturbing. The condition can make people to avoid areas or situations that remind them of their traumatic experience. This can lead individuals to feel isolated and depressed. The good news is that PTSD can be treated with the help of counseling and medication, as well as support from loved ones.

A new lawsuit filed by Black veterans and a Yale law clinic has found that the Department of veterans disability attorneys Affairs has consistently denied disability compensation claims to Black veterans for decades. Quil Lawrence of NPR reports that a VA whistleblower notified the vets that VA documents showed that Black veterans were denied benefits at a higher rate than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites figures showing that between 2001 and 2020, the percentage for Black veterans disability attorneys who filed disability claims was rejected at 29.5% compared to only 24.2% of white veterans.

The lawsuit seeks damages for compensation for Monk and other Black veterans who were unfairly denied access to benefits. It also demands the VA to reconsider the thousands of other claims that were wrongly dismissed. The lawsuit was filed in federal court earlier this week.

Traumatic Brain Injury

TBI can be mild, moderate, or severe and symptoms can be immediately evident or develop hours or even weeks after the injury.
