Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

For many veterans who suffer from disabilities resulting from their military service, a veterans disability lawsuit might be the answer. The Department of Veterans Affairs provides benefits to those who have been in the military, including medical care and special programs.

However, obtaining those benefits isn't easy for Black veterans, as per a lawsuit filed on Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's veterans Disability lawyers Legal Services Clinic.

PTSD

When someone is traumatized, it can cause them to develop symptoms of post traumatic stress disorder (PTSD). Symptoms include anxiety, nightmares, or frightening flashbacks. The condition can also cause a person to avoid certain places or situations that bring back memories of the traumatic event. This can lead people to feel isolated and depressed. Therapy, medication, and support from family members can treat PTSD.

A new lawsuit brought by Black veterans and a Yale law clinic has found that the Department of Veterans Affairs has repeatedly denied disability compensation claims to Black veterans for a long time. Quil Lawrence of NPR reports that a VA whistleblower revealed to the vets that VA documents showed that Black veterans were denied benefits at a higher rate than white veterans.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites figures showing that between 2001 and 2020, the rate for Black veterans of disability claims was rejected at 29.5 percent, as compared to 24.2 percent of white veterans.

The lawsuit seeks compensatory damage for Monk and Black veterans who were wrongfully denied benefits. The lawsuit also seeks to for the VA to review tens of thousands of other claims that were wrongly denied. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

Research suggests that having multiple moderate to severe TBIs can increase the risk of developing dementia and other movement disorders later in life.

Post Traumatic Stress Disorder

Post-traumatic stress disorder (PTSD) occurs when the victim experiences trauma. The symptoms can start when the event is over or even years later. They could include memory problems, difficulty in concentrating and sleeping, feelings of anger and irritability, and being easily frightened or jumpy. People may experience depression or suicidal. PTSD can cause issues at work, in the home and in relationships. It can also trigger alcohol or veterans disability lawyers drug dependence.

The symptoms can be treated using psychotherapy, including eye movements desensitisation and Reprocessing (EMDR) or cognitive processing therapy. Some sufferers of PTSD benefit from taking antidepressants, such as selective serotonin-reuptake inhibitors or SNRIs. Medications can help control the symptoms and help you get through everyday activities.

Some research is exploring how to prevent PTSD by examining the possibility that genes or the brain can affect a person's response to a trauma. Researchers are studying how a normal reaction to stress can develop into PTSD, and how to treat it early.

Depression

The lawsuit alleges that the VA discriminated against Black veterans for decades by refusing disability claims at a higher percentage than white veterans. It was filed on behalf of Conley Monk who is an Vietnam War veteran who tried to access medical benefits, housing assistance and education benefits for 50 years. The suit is being filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful fight to reverse his less-than honorable military discharge due to PTSD and other injuries.

The lawsuit asserts that racial bias in the justice system of the military affected the discharge status of a number of Black service members and VA officials should have been aware this when they made disability compensation decisions. The lawsuit cites a study that revealed that, between 2001 and 2020 the average rate of denials for Black veterans who applied to receive disability compensation was 29,5% as opposed to 24,2% for white veterans.
