Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit
For many veterans suffering from disabilities due to their military service, a disability lawsuit could be the solution. The Department of Veterans Affairs offers benefits to veterans, such as medical care and special programs.
However, getting those benefits isn't easy for Black veterans, as per a new lawsuit filed Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.
PTSD
PTSD symptoms can arise when people are traumatized. It can manifest as flashbacks, nightmares or anxiety that are disturbing. The condition can cause people to avoid certain places or situations that trigger the traumatic event. This can lead people to feel isolated and depressed. Counseling, medication and support from family members can help in treating PTSD.
A new lawsuit brought by Black veterans and a Yale law clinic has revealed that the Department of Veterans Affairs has been systematically denying disability compensation claims to Black vets for decades. Quil Lawrence of NPR reports that a VA whistleblower revealed to the vets that VA documents showed that Black veterans were denied benefits in a higher proportion than their white counterparts.
The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics that show that from 2001 to the rate of rejection for Black disability claims was 29.5 percent, compared with 24.2 percent for white veterans.
The lawsuit seeks to recover compensation for Monk and Black veterans who were wrongfully denied benefits. It is also seeking to force the VA to review the claims of thousands of other veterans who were incorrectly dismissed. The lawsuit was filed this week in federal court.
Traumatic Brain Injury
TBI symptoms can be acute or may develop for hours, days or even weeks later. Some signs (headache dizziness, headache) are physical, whereas others could be related to emotions, memory, concentration or behavioral issues. TBI patients may also experience trouble moving or having problems with vision and balance.
The damage to the brain caused by a TBI can be caused by a bump, a blow or jolt to the head whether from a blunt force or penetrating cut (such as a bullet). The impact may cause the skull to break and cause bleeding and bruising of the brain within the skull. The brain may expand and press against the skull, causing blood circulation. The injury could occur throughout the entire brain or in the lobe in which it is located.
Certain TBIs are classified as open while others are closed. The classification is based on whether or not the skull was fractured and whether or not the skull was opened or shut by the impact. TBIs range in severity, ranging from concussions all the way to coma. People who suffer from TBI are more at risk of developing depression, PTSD and other mental health conditions. Research suggests that having multiple moderate to severe TBIs could increase the likelihood of developing dementia and movement disorders in later life.
Post Traumatic Stress Disorder
Post traumatic stress disorder, or PTSD develops when people experience a trauma. The symptoms can manifest immediately following the event or even years after. They may include memory problems, difficulty in concentrating and sleeping, feelings of anger and irritability, and being easily frightened or jittery. People may experience depression or suicidal. PTSD can create problems at home, work, and even in relationships. It can also cause alcohol or drug dependence.
Psychotherapy can be used to treat symptoms such as eye movement desensitisation (EMDR) and cognitive processing therapy. Antidepressants like selective Serotonin Reuptake Inhibitors (SNRIs) can be beneficial for people suffering from PTSD. The medications can help manage the symptoms and help people get through daily activities.
Some research examines how to avoid PTSD. This includes examining how the brain and genes influence a person's reaction to a trauma. Other studies are looking at the ways in which a normal stress response changes into PTSD and how to treat it earlier.

It is important to address symptoms that interfere with your daily life such as difficulties in relating to others, or feeling annoyed and frustrated.
