Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit
A veterans disability lawsuit could be the solution for a large number of veterans suffering from disabilities as a result of their military service. The Department of Veterans Affairs provides benefits to those who have been in the military, including medical care and specialty programs.
However, getting those benefits is particularly difficult for Black veterans, according to a new lawsuit filed on Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.
PTSD
PTSD symptoms can arise when someone is traumatized. Symptoms include anxiety, nightmares or troubling flashbacks. A new lawsuit jointly filed by Black veterans and the Yale law clinic found that the Department of Veterans Affairs denied disability compensation claims for Black veterans consistently over the course of decades. Quil Lawrence of NPR reports that a VA whistleblower notified the veterans that VA documents revealed that Black veterans were denied benefits at a higher percentage than white veterans.
The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites data that shows that from 2001 to 2020 the rejection rate for Black disability claims was 29.5 percent, compared with 24.2% for white veterans.
The lawsuit seeks compensation for Monk and Black veterans who were wrongfully denied benefits. The lawsuit also seeks to for the VA to review tens or thousands of other claims which were denied in error. The lawsuit was filed in federal court on Wednesday.
Traumatic Brain Injury
