How to File a Medical Malpractice Case

A malpractice case is one in which a medical professional fails to treat a patient in line to accepted standards of care. For instance, if an orthopedic surgeon commits a mistake during surgery, resulting in damage to the nerves of the femoral area, it could be considered medical malpractice.

Duty of care

The doctor-patient relationship has the obligation of care all medical professionals have to fulfill in their duties. An experienced attorney will know how to work with the most qualified experts. Not all medical professionals have the qualifications to work on malpractice claims. In complex cases it is possible for the expert to submit specific reports and be present to appear in the courtroom.

Breach of duty
