Asbestos Legal Matters

After a long struggle, asbestos legal measures resulted in the partial ban of 1989 on the manufacturing, processing, and distribution of the majority of asbestos-containing products. The ban remains in place.

The December 2020 final TSCA risk evaluation for chrysotile asbestos revealed unacceptable health risks to humans for all current uses of chrysotile asbestos. The April 2019 rule bans the return of these asbestos products to commerce.

Legislation

Asbestos laws are enforced both at the state and federal levels in the United States. While many industrialized countries have banned asbestos however, the US still uses it in a number of different products. The federal government regulates the use of asbestos in these products as well as regulates asbestos litigation. While the federal laws generally are consistent nationwide, state asbestos laws vary according to the state in which they are located. These laws often restrict claims made by those who have suffered from exposure to asbestos.

Asbestos is a natural mineral. It is extracted from the ground using open-pit mining methods and consists of fibrous strands. These strands are then processed and mixed with cement or another binding agent to produce Asbestos Compensation-containing material (ACM). These ACMs are utilized in a variety of applications, including flooring tiles, shingles, roofing, and clutch faces. In addition to its use in construction materials, asbestos is found in a number of other products, including batteries as well as gaskets, clothing that is fireproof and gaskets.

While there isn't any asbestos ban at the federal level however, the Environmental Protection Agency (EPA) has strict rules regarding the use of asbestos in homes and schools. The EPA requires schools to inspect their facilities and come up with plans for the identification, containment and management of asbestos-containing materials. The EPA demands that anyone working with asbestos must be certified and accredited.

Asbestos is an extremely complex substance that requires specialized expertise and equipment. Any work that is likely to cause damage to asbestos-containing materials, a licensed asbestos removal contractor is required. The regulations require the contractor to notify the enforcing authority of any asbestos-related work and submit a risk assessment for every asbestos removal project. They also need to establish a decontamination zone and provide employees with protective clothing and equipment.

After the work is finished the certified inspector should inspect the area and verify that no asbestos fibers have escaped into the air. The inspector should also verify that the sealant has "locked down" any remaining asbestos. An air sample should be taken after the inspection, and if it shows more asbestos than required, the area must be re-cleaned.

The transportation and disposal of asbestos is regulated by the state of New Jersey and is monitored by the Department of Environmental Protection (DEP). Any company planning to dispose of asbestos-containing material must obtain a permit from Department of Environmental Protection before commencing work. This includes professional service companies and asbestos abatement technicians. The permit must include a description of the area and the kind of asbestos to be disposed of and the method of transported and stored.

Abatement

Inhaling them poses a threat because the fibers cannot be seen by the naked eye. ACM that is not friable, such as encapsulated floor coverings or drywall, is not able to release fibers.

A licensed contractor who wants to undertake abatement work on a structure has to be granted a permit by the Iowa Division of Labor. The contractor must also inform Iowa OSHA and the Department of Natural Resources. The initial and annual notifications require the payment of a fee. Additionally, those who plan to work at an educational establishment must provide the EPA with abatement plans and training for employees. New Jersey requires all abatement firms to have a license issued by the Department of Labor and Workplace Development and their employees to hold supervisor or worker permits.

Litigation

Asbest cases flooded state courts and federal courts in the late 1970s and into the early 80s. The majority of these claims were filed by workers who suffered respiratory problems as a result of asbestos exposure. Many of these illnesses have now been diagnosed as mesothelioma, along with other cancers. The cases have prompted several states to adopt laws designed to limit the number of asbestos lawsuits filed in their courts.

The laws set out guidelines for identifying asbestos products and employers in a plaintiff’s case. The laws also provide procedures for obtaining records of medical treatment and other evidence.
