While the laws regarding motor vehicle accident lawsuits vehicles vary by state, there's certain similarities across the country in the areas of titling registration, fees, taxes, and drivers' licenses. To allow an imported car to be considered legally titled in the United States, it must meet the Department of Transportation (DOT) and Environmental Protection Agency (EPA) regulations. DOT standards demand particularly that motor vehicles not older than 25 years conform to safety and bumper requirements and that every automobile be labeled by the manufacturer as meeting these standards.
EPA regulations also stipulate that all vehicles must meet air pollution emission standards. If a non-resident wants to import a car that is not in compliance with the standards, they must to submit EPA form HS-7 and DOT form 3520-1 along with CBP to get prior approval from EPA.
Imported Vehicles for Racing
The laws governing motor vehicles differ from state to state, however, there are a lot of similarities across the nation regarding registration of vehicles and being licensed to drive. The National Highway Traffic Safety Administration within the Department of Transportation, establishes and enforces standards for cars and other equipment. Vehicles Imported for Touring
Motorists who visit the United States as tourists from Central and South American countries which have ratified the Inter-American Convention of 1943 may use their vehicles in the United States for one year or the validity period of their passports or the shorter period as long as they do not need license plates or driver's permits. They must show EPA forms AP3520-1 or DOT 7 upon entry.
Imported vehicles for touring are also subject to 40% Customs duty and 10 percent VAT, as as an ad valorem rate ranging from 15% to 100% based upon the piston displacement. These taxes and duties also apply to spare parts that are sent with the imported auto. The car owner must be present in person.
Vehicles imported for commercial use
The law defines "motor vehicle" as any device that is capable of transporting property or people and that is driven by power other than muscular power, except (a) electric personal assistive mobility devices that are operated or driven by a person who has disabilities; (b) farm type tractor used for the operation of a farm business or implements of husbandry or snow plowing; (c) vehicles which run solely on tracks or rails and (d) all-terrain vehicles. Each state's laws may differ from the definition and any vehicle that meets the definition of the statute is subject to the state's licensing and registration as well as financial responsibility laws.
