Medical malpractice cases involve injuries that result from the negligence of the healthcare professional. There are numerous laws that govern such cases, including specific statutes of limitations and damages.
The term "malpractice" refers to the situation where a physician, hospital or other healthcare professional fails to treat a patient with the same level of care that other physicians would offer in similar situations. This includes misdiagnosis, surgical mistakes.
Complaint
Medical malpractice is a special part of tort law that is devoted to professional negligence. It is defined as an act or omission committed by the doctor that goes against the accepted norms in the medical profession that causes injuries to patients [22].
Your lawsuit begins when you start a civil court action when you've suffered injuries by negligence in a hospital. In this paper, you describe the details of your case. You must also identify the hospital where you worked and any physicians involved with your case. Malpractice claims can be filed with the state trial court which has jurisdiction over the case. However, in some circumstances they can also be filed in federal district courts. Both trial courts are governed by the same laws as other civil litigants. Depositions of the defendant physician are typically held in which the attorneys from both sides inquire about the medical records of the defendant. After direct examination, the opposing attorney can cross-examine a doctor who has testified. The procedure continues until both parties have exhausted their questions.
