Asbestos Legal Matters

After a long and arduous battle and a long period of legal action, asbestos legal measures resulted in the partial ban in 1989 of the manufacturing, processing, and distribution of most asbestos-containing products. This ban remains in effect.

The December 2020 final TSCA risk assessment for chrysotile asbestos revealed unreasonable health risks to humans for all uses that continue to use chrysotile asbestos. The April 2019 rule bans the return of asbestos products to commerce.

Legislation

Asbestos laws are regulated both at the state and federal levels in the United States. Although most industrialized nations have banned asbestos but the US still uses it in a variety of different products. The federal government regulates how it is used in different products, and also regulates asbestos litigation and abatement. State asbestos laws can vary from one state to another however federal laws generally are uniform. These laws often restrict claims for those who have suffered exposure to asbestos.
