The Basics of Malpractice Law

Malpractice is a crime committed when a professional violates generally accepted guidelines of practice. It can be brought against doctors, lawyers or any other professional who makes mistakes that significantly impact the client's case.

Medical malpractice claims can be complicated and require a deep understanding of New York's statutes regulations, statutes, and case law. A successful malpractice case must show the following elements:

Duty of care

The duty of care is a crucial aspect in any malpractice case. Medical professionals are required to adhere to a duty to act in a way that a reasonable person would under similar circumstances. If they violate this obligation and cause injury, they could be held accountable for negligence. The scope of this duty varies from one medical professional to the next and is dependent on a myriad of factors.

It is widely accepted that a doctor's duty of care extends beyond the patient and can include third parties.
