Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A lawsuit for veterans disability law firm' disability could be a solution for a lot of veterans suffering from disabilities as a result of their military service. The Department of Veterans Affairs offers benefits to veterans, such as medical care and special programs.

However, obtaining these benefits is a lot more difficult for Black veterans, according to a lawsuit filed on Monday. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.

PTSD

A new lawsuit brought by Black veterans and a Yale law clinic has found that the Department of Veterans Affairs has repeatedly denied disability compensation claims to Black veterans for decades. Quil Lawrence of NPR reports that a VA whistleblower notified the vets that VA documents showed that Black veterans disability lawyers were denied benefits at a higher percentage than white veterans.

The lawsuit was brought by Marine Vietnam veteran Conley Monk and Yale's Veterans Legal Services Clinic. The lawsuit cites statistics showing that between 2001 between 2001 and 2020, the average rate for Black veterans' disability claims was rejected at 29.5 percent, compared to 24.2% of white Veterans Disability Lawyers.

The lawsuit seeks compensatory damages for Monk and other Black veterans who were denied access to benefits. The lawsuit also seeks to oblige VA to reassess tens of thousands of other claims which were incorrectly denied. The lawsuit was filed in federal court earlier this week.

Traumatic Brain Injury

TBI can be mild, moderate or even severe and symptoms may be immediately apparent or they may develop days or weeks after the injury. TBIs can vary in severity, ranging from a concussion up to a coma. People suffering from TBI are more at risk of developing depression, PTSD and other mental health issues. Certain studies suggest that having multiple moderate to severe TBIs may increase the risk of developing dementia and other movement disorders later in life.

Post Traumatic Stress Disorder

Post traumatic stress disorder, or PTSD develops when people undergo a trauma. Symptoms can start as soon as the event has ended or a few years later. They may include memory issues as well as difficulty with concentration and sleep, a feeling of anger and irritability and being easily scared or jittery. The lawsuit claims that racial discrimination in the military justice system affected the discharge status of a lot of Black service members and VA officials should have recognized this when making the decisions on disability compensation. The lawsuit cites research that revealed that, between 2001 and 2020, the average denial rate of Black veterans who applied for disability compensation was 29,5%, compared with 24,2 percent for white veterans.
